Turkish Customs 24 Hour Advanced Manifest Rule

 

You may already be aware that the Turkish Customs 24 Hour advanced manifest rule takes effect on 1st January 2012 and applies to all Turkish ports. This rule will apply to any container vessel that commences loading after midnight on 31st December 2011 or PCC/Bulk vessel discharging after midnight on 31st December 2011. The rule is closely based on the current EU24 hour rule with many similarities in data requirements.

 

For import cargo to all Turkish ports the rule requires that an ˇ§entry summary declarationˇ¨ is submitted as follows:

Container Vessels  - 24 hours prior to the vessel commences loading at each Foreign port

PCC/Bulk Vessels -  4 hours prior to vessels arrival at Turkish Port.

Short Sea Vessels ˇV 2 hours prior to vessel arrival at Turkish Port.

 

Turkish law states that declarations must be made by a Turkish based representative of the carrier. This means that K Line Turkey office will make the declarations. 

 

Submission of the ENS must be made by ˇ§Kˇ¨ Line at the actual port of loading on the Turkish calling vessel. It should be made to Customs at the first Turkish port of call on the vessels itinerary. The Turkish Customs office at this port will carry out a security risk assessment of all cargo and transmit the results to subsequent Turkish ports Customs.

 

All ENS declarations are ultimately the Carrierˇ¦s (ˇ§Kˇ¨ Lineˇ¦s) responsibility although NVOCCs and other third parties may file with the Carrierˇ¦s written agreement. The ruling applies to all cargo intended for discharge at Turkish ports, all transhipment cargo to be feedered to Turkish or non Turkish ports and all transit cargo for non Turkish final destinations.  It does not apply to cargo remaining on board vessel for non Turkish destinations.

 

The system is partly manual and edi is only possible between K Line Turkey offices and Turkish Customs. There is no provision for carriers to make direct edi of ENS declarations from port of loading.  This will require an earlier cut off time for shipping instructions than is needed for the fully automated EU 24 system to allow for manual handling of any rejections.

 

The ENS must contain specific data elements, which must be accurate since checks by Turkish Customs will be made electronically.  Failure to provide this information correctly will result in an increased risk of rejection by Turkish Customs.

 

 

 

 

 

 

 

The rule will require the following from our customers to allow ˇ§Kˇ¨ Line to comply with the regulations:

 

i)                    All data submitted in Shipping Instructions must be accurate.

 

ii)                  Shipping instructions must be received in a timely manner to allow input to our systems and submission of ENS at the latest 24 hours before vessel commences loading.

 

iii)                Note there is no period of grace from Turkish Customs, we will be expected to comply fully from 1st January 2012.

 

 

Information required from our customers for the ENS submission is almost identical to that required in the present Shipping Instruction (SI). The main differences are a need for greater accuracy in addresses, cargo descriptions and any code numbers provided. The following details are the additional information that is required:

 

1.                  HS codes (Rule requires 4 digits, but 6 digits are preferred.)

 

2.                  Tax registration number of Turkish Consignee and Notify Party.

 

Concerning item 1, general vague cargo descriptions may be rejected by Turkish Customs. If you have the HS code for your cargo, we highly recommend that you provide that code in addition to the cargo description. Rule requires 4 digits as minimum but we strongly recommend you to provide 6 digits.

 

Cut off times for shipping instructions will be advised locally at each port of loading and are subject to local practices and procedures. Indications are that a cut off around 48 hours before vessel commences operations will be required, but this may change based on the results of testing. The lack of automation means that weekends and holidays in both Turkey and countries of origin must also be taken into account.
